Frequently Asked Questions
Answers to the questions people ask most about GIFT City funds, NRI and OCI investing, taxation and how to invest.
GIFT City funds
Read the guideWhy does GIFT City matter to an investor?
It is India's first International Financial Services Centre, in Gujarat, and it gives managers and investors a globally competitive base: clear rules, meaningful tax relief, and portfolios that can be held in foreign currency. The ambition is to stand alongside Singapore and Dubai without leaving the Indian regulatory perimeter.
Who regulates funds in GIFT City?
IFSCA, a single authority covering securities, banking, insurance and pensions inside the zone. Master funds follow SEBI-aligned norms, while IFSCA adds flexibility for cross-border structures and global participation.
Can resident Indians invest?
Yes, through the Liberalised Remittance Scheme, which permits up to USD 250,000 per financial year. That is enough to participate in dollar-denominated AIFs or PMS mandates managed from GIFT City.
What is the minimum investment in a GIFT City AIF?
USD 75,000 per investor is the standard floor. Accredited investors may be offered a lower minimum at the asset manager's discretion.
What tax relief do non-residents get?
Capital gains are exempt for Category I and II AIFs subject to specific provisions, interest income from IFSC entities is tax-free, dividend withholding is capped at 10%, and there is no securities transaction tax on securities listed in GIFT IFSC.
Can these funds invest outside India?
Yes. AIFs and PMS mandates in GIFT City can hold both Indian and global assets, which lets managers build genuinely hedged global portfolios - something a purely domestic fund cannot do.
How are Category III AIFs different?
They are usually built for long-only, long-short, arbitrage or hedged strategies, can use leverage within regulatory limits, and suit investors chasing absolute returns with a higher tolerance for risk.
Is repatriation straightforward?
It is designed to be. Because the funds sit under IFSCA rules and typically operate international bank accounts, moving capital out is smoother than from an onshore fund.
What reporting do these funds follow?
Quarterly filings with IFSCA, full KYC and AML compliance, and valuation, audit and risk disclosures comparable to SEBI standards. Where overseas investors are accepted, FATCA, CRS and OECD norms apply too.
What are the risks?
Lock-ins can run three to seven years or longer, currency moves cut both ways, and private or global strategies bring complexity and valuation uncertainty. Read the private placement memorandum closely and speak to a qualified adviser before committing.
NRI / OCI investing
Read the guideCan NRIs invest in GIFT City funds?
Yes, eligible NRIs and OCIs can invest in IFSC funds that permit them, subject to fund-specific and regulatory requirements. IFSCA has specifically facilitated greater NRI/OCI participation in Indian securities through IFSC-based funds.
Can an NRI invest in India in USD through GIFT City?
Certain GIFT IFSC funds accept foreign-currency subscriptions and may provide India exposure. The exact currency and route must be checked for the individual scheme.
Do I have to convert USD into INR before investing?
Not necessarily where the relevant IFSC fund accepts USD or another permitted foreign currency. The underlying fund may subsequently invest in INR assets.
Does that remove INR/USD currency risk?
No. Subscription currency and underlying portfolio currency are different things.
What is the minimum investment in a GIFT City fund?
There is no universal minimum. Restricted Schemes generally have a USD 150,000 threshold for non-accredited investors under current IFSCA rules, while other structures can have different minimums.
Are GIFT City funds tax-free for NRIs?
Not universally. Tax depends on the fund structure, income/transaction, Indian tax provisions and the investor's country of tax residence.
Can an OCI invest?
Eligible OCIs can participate in IFSC funds subject to the individual scheme and applicable regulations. IFSCA's NRI/OCI facilitation framework explicitly covers OCIs.
Can a U.S.-based NRI invest?
Potentially, where the fund accepts the investor, but U.S. taxpayers should separately examine U.S. tax classification and potential PFIC/Form 8621 implications.
Who regulates GIFT City funds?
Fund-management activity in GIFT IFSC is regulated by IFSCA, the International Financial Services Centres Authority.
Where can I see GIFT City funds?
GIFTCity360's Funds section contains the deeper tracked universe, while Marketplace shows the broader fund universe available across GIFT IFSC.
How to invest
Read the guideDo I need a GIFT City bank account?
Not in every case. Resident Indians can open an IFSC FCA for permissible LRS purposes; the actual fund subscription route depends on the FME and bank.
Can I invest directly from India?
Resident individuals can remit for permitted IFSC financial products under LRS, subject to the USD 250,000 annual limit and applicable rules.
Can NRIs use LRS?
LRS is a resident-individual scheme. An NRI investing from abroad generally follows the fund's non-resident onboarding/remittance route.
How long does onboarding take?
There is no universal timeline. It depends on KYC completeness, bank/FME checks and the fund's dealing cycle.
Where do I see all available funds?
Use GIFTCity360 Marketplace for the broad universe and Funds for products with deeper tracked data.
Taxation
Read the guideAre GIFT City funds tax-free?
Not as a universal rule. Specific Indian exemptions/concessions exist for qualifying IFSC structures and transactions, but product and investor facts determine the result.
Do NRIs pay capital gains tax in India?
It depends on the exact structure, asset/income and statutory provision. A product-specific answer is required.
Does an NRI need to pay tax in the country where they live?
Potentially yes. Indian tax treatment does not replace the rules of the investor's tax-residence country.
Is there GST on every GIFT City fund fee?
Do not state a universal rule. Indirect-tax treatment depends on the service, provider, recipient and applicable IFSC provisions.
Does TCS apply to NRIs investing from overseas?
The LRS/TCS discussion is primarily relevant to resident-Indian remittances under LRS, not simply to an NRI wiring money from abroad.
How often should this page be reviewed?
At least after each Union Budget/Finance Act and whenever RBI, IFSCA or the Income Tax Department changes a relevant rule.
Inbound vs outbound
Read the guideIs every India-focused GIFT fund an inbound fund?
As a GIFTCity360 discovery label, generally an India-focused fund funded by offshore/non-resident capital can be grouped as inbound, but verify the actual mandate and legal route.
Can resident Indians invest in inbound funds?
Do not assume. Eligibility depends on the scheme and applicable FEMA/IFSCA/SEBI framework.
Can NRIs invest in outbound funds?
Potentially, where the scheme accepts them, but they should compare the value proposition with investment options already available in their country.
Does outbound mean money leaves India permanently?
No. It describes investment exposure/direction. Funding, holding, redemption and repatriation follow the applicable legal and product framework.
Which is better, inbound or outbound?
Neither is inherently better. They solve different portfolio goals: India exposure versus international/global exposure.
